Paternity leave and pay are different questions

The legal position

From 6 April 2026, paternity leave entitlement starts from the first day of employment. Eligible employees can generally take one or two weeks, subject to the relevant conditions and notice rules. The removal of the leave service requirement does not remove the separate qualifying requirements for statutory paternity pay. Birth, adoption and overseas adoption involve different details, so the relevant route needs checking rather than relying on one generic form.

Using it in practice

Create a decision guide that separates time away from work, statutory pay and any enhanced contractual benefit. Ask only for the information needed to establish entitlement and administer the leave. Make it easy for a new starter to find the process. Check that payroll and manager templates use the same current rules and that communications do not incorrectly imply unpaid leave is unavailable because statutory pay is not due.

A new employee requests paternity leave soon after joining. An old policy rejects the request because they lack the former service period. HR’s updated process checks the day-one leave right, the specific notice circumstances and pay eligibility separately. The employee receives a clear explanation of the available leave and how it will be paid, with a route to correct missing information.
